Opinion

F042264.

11-14-2003

THE PEOPLE, Plaintiff and Respondent, v. CARLOS MORALES CASTRO, Defendant and Appellant.

William D. Farber, under appointment by the Court of Appeal, for Defendant and Appellant. Bill Lockyer, Attorney General, Robert R. Anderson, Chief Assistant Attorney General, Jo Graves, Assistant Attorney General, and Carlos A. Martinez, Deputy Attorney General, for Plaintiff and Respondent.

OPINION

THE COURT

After a bench trial, the court found appellant, Carlos Morales Castro, guilty of arson of property (Pen. Code, § 451, subd. (c)). On December 20, 2002, the court sentenced Castro to the middle term of four years.

Castros appellate counsel has filed a brief which summarizes the facts, with citations to the record, raises no issues, and asks this court to independently review the record. (People v. Wende (1979) 25 Cal.3d 436.) Castro has not responded to this courts invitation to submit additional briefing except with a letter filed on June 10, 2003, wherein he does not raise any issues.

Further, following independent review of the record we find that no reasonably arguable factual or legal issues exist.

The judgment is affirmed. --------------- Notes: Before Cornell, Acting P.J., Gomes, J., and Dawson, J.
