People v. Castillo

Appellate Division of the Supreme Court of New York, First Department
Nov 28, 2000
277 A.D.2d 129 (N.Y. App. Div. 2000)

Opinion

November 28, 2000.

Judgment, Supreme Court, Bronx County (John Moore, J.), rendered February 18, 1998, convicting defendant, after a jury trial, of assault in the first degree, and sentencing him to a term of 3 1/2 to 7 years, unanimously affirmed.

Cheryl D. Harris, for respondent.

Daniel Hsiung, for defendant-appellant.

Before: Sullivan, P.J., Rubin, Saxe, Buckley, Friedman, JJ.

Defendant's suppression motion was properly denied. There is no basis upon which to disturb the court's credibility determinations. The record supports the court's finding that the officer's translation of theMiranda warnings into Spanish conveyed, in substance, all the necessary information (see, People v. Lewis, 163 A.D.2d 328, lv denied 76 N.Y.2d 941).

THIS CONSTITUTES THE DECISION AND ORDER OF SUPREME COURT, APPELLATE DIVISION, FIRST DEPARTMENT.
