DECISION & ORDER ON MOTION

Motion by Immigrant Defense Project for leave to file an affirmation as amicus curiae in support of the defendant's application pursuant to CPL 450.15 and 460.15 for a certificate granting leave to appeal to this Court from an order of the Supreme Court, Kings County, dated May 7, 2012. Separate motion by Immigrant Defense Project to admit pro hac vice Dawn Seibert, an attorney in good standing in the State of Vermont, to represent it on the affirmation as amicus curiae in support of the defendant's application.

Upon the papers filed in support of the motions and the papers filed in relation thereto, it is

ORDERED that the motion for leave to file an affirmation as amicus curiae is denied; and it is further,

ORDERED that the motion to admit Dawn Seibert pro hac vice is denied as academic.
