ORDER MODIFYING OPINION [no change in the judgment]

THE COURT:

The opinion filed herein July 23, 2007 is modified as follows: The third sentence in the second full paragraph on page 8 (beginning with “On January 27, 2006,”) is modified to delete the phrase “additional written materials, including[.]” As modified, the sentence now reads: “Castillo neither submitted any declarations from his appointed experts, sought to call any witnesses, nor made any offers of proof regarding any proposed evidence.”

This modification does not affect the judgment.

In all other respects, the petition for rehearing is denied.
