Opinion

No. 121857 (73).

July 28, 2003.

COA: 230526, Wayne CC: 99-012607

On order of the Court, the motion for reconsideration of this Court's order of April 9, 2003 is considered, and it is DENIED, because it does not appear that the order was entered erroneously.

Cavanagh, J., would grant reconsideration to consider whether a number of errors combined to deny defendant due process.

Kelly, J., would grant reconsideration and, upon reconsideration, would grant leave to appeal.

Markman, J., would grant reconsideration and, upon reconsideration, would remand to the Wayne Circuit Court for a Ginther hearing.
