MOTION DECISION

An order of this Court having been entered on April 13, 2021 (M-860) granting defendant leave to prosecute, as a poor person, the appeal taken from the judgment of the Supreme Court, Bronx County, rendered on or about October 09, 2020, and assigning Caprice R. Jenerson, Esq., Office of the Appellate Defender, as counsel to prosecute the appeal; and an order of this Court having been entered on March 08, 2022 (M-403) amending the aforesaid order of assignment to include a judgment of resentence, same Court, rendered on or about April 13, 2021; and assigned counsel having moved to be relieved as such counsel, or in the alternative, to dismiss the appeal without prejudice, Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon, It is ordered that the motion is granted to the extent of deeming the appeal withdrawn.
