By order of April 2, 2002, the delayed application for leave to appeal from the August 8, 2001 decision of the Court of Appeals was considered, and the prosecutor was directed to file a response within 28 days. The prosecutor having filed a response to the delayed application, the delayed application for leave to appeal is again considered, and it is DENIED, because the defendant has failed to meet the burden of establishing entitlement to relief under MCR 6.508(D).
