People v. Carpenter

Appellate Division of the Supreme Court of New York, First Department
Oct 5, 2000
276 A.D.2d 280 (N.Y. App. Div. 2000)

Opinion

October 5, 2000.

Judgment, Supreme Court, New York County (James Yates, J.), rendered February 24, 1998, convicting defendant, after a jury trial, of criminal possession of a weapon in the third degree, and sentencing him to a term of 1 to 3 years, unanimously affirmed.

Vincent Rivellese, for respondent.

Debra Fox, for defendant-appellant.

Before: Nardelli, J.P., Tom, Andrias, Buckley, Friedman, JJ.

The verdict was not against the weight of the evidence (People v. Bleakley, 69 N.Y.2d 490). Issues of credibility were properly presented to the jury and there is no reason to disturb its determinations.

THIS CONSTITUTES THE DECISION AND ORDER OF SUPREME COURT, APPELLATE DIVISION, FIRST DEPARTMENT.
