People of Michigan v. Christopher Michael Cantu

LC No. 04-011218-FH

ORDER

Elizabeth L. Gleicher, Chief Judge, acting under MCR 7.203(F)(1), orders:

The motion to waive fees is GRANTED for this case only.

The delayed application for leave to appeal from the January 6, 2021 order is DISMISSED for lack of jurisdiction because appellant failed to file the application within the time period required by MCR 7.205(A)(2). Even timing the due date of the application from April 8, 2021, when the trial court denied defendant's motion for reconsideration, and considering the fact that defendant mailed a notice of intent under AO 2020-21, the application was not timely filed when one accounts for the time that passed between the date of entry of the order denying reconsideration and the mailing of defendant's notice of intent.
