People of Michigan v. Travis Joseph Calloway

LC No. 18-018798-FH

Kirsten Frank Kelly Presiding Judge Anica Letica Noah P. Hood Judges

ORDER

The Court orders that the stipulated motion to remand is GRANTED. This case is REMANDED to the trial court for entry of any lawful order that effectuates the parties' agreed resolution of this matter. This Court retains jurisdiction. The parties shall file a stipulation to dismiss the appeal under MCR 7.218(B) after the trial court's order resolving the matter has been entered. Proceedings on appeal will resume if the appeal has not been dismissed within 42 days after the date this remand order is entered.

Hood, J., would deny the stipulated motion to remand as unnecessary. MCR 7.208(A)(2) provides that the trial court retains the authority to vacate or amend the order appealed from on the stipulation of the parties. This would more efficiently effectuate the parties agreement.
