People v. Callaway

Appellate Division of the Supreme Court of New York, Second Department
Oct 4, 1982
90 A.D.2d 487 (N.Y. App. Div. 1982)

Opinion

October 4, 1982

Appeal by defendant from a judgment of the County Court, Suffolk County (Seidell, J.), rendered January 6, 1981, convicting him of burglary in the third degree, upon a plea of guilty, and imposing sentence. Judgment affirmed. We have reviewed the record and agree with defendant's assigned counsel that there are no meritorious grounds which could be raised on this appeal. Counsel's application for leave to withdraw as counsel is granted (see Anders v. California, 386 U.S. 738; People v. Paige, 54 A.D.2d 631; cf. People v. Gonzalez, 47 N.Y.2d 606). Lazer, J.P., Mangano, Gibbons and Brown, JJ., concur.
