ORDER MODIFYING OPINION, NO CHANGE IN JUDGMENT.

THE COURT:

It is ordered that the opinion filed herein on November 6, 2006, be modified as follows:

On page 7, the first sentence of the first paragraph, the word “construction” is changed to “causation” so the sentence reads:

In the present case, the award of actual custody credit does not pass the strict causation test.

This modification does not affect the judgment.
