People of Michigan v. Brandon Lewis Cain

LC No. 05-012544-01-FC

ORDER

Christopher M. Murray, Chief Judge, acting under MCR 7.203(F)(1), orders:

The motion to waive fees is GRANTED for this case only.

The motion to "accept pleadings 'as is'" is GRANTED.

The application for leave to appeal is DISMISSED for lack of jurisdiction because the lower court had not entered an order before appellant filed the application on August 2, 2021; thus, the application is premature. MCR 7.203(B) and 7.205(A). The April 29, 2021 letter returning defendant's successive motion for relief from judgment is not an order that may be appealed.
