Defendant having moved pursuant to CPL 460.30 to extend the time to move for leave to appeal from an order of the Onondaga County Court, entered July 6, 2010,

Now, upon reading and filing the statement of James Cahill dated July 20, 2011, the notice of motion with proof of service thereof, the letter of James P. Maxwell, Esq. dated July 28, 2011, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is dismissed as unnecessary.
