ORDER MODIFYING OPINION [NO CHANGE IN JUDGMENT] THE COURT:
It is ordered that the published opinion filed herein on August 4, 2011, be modified as follows:
1. At the end of the paragraph beginning near the middle of page 43 and ending near the middle of page 44, the following sentence should be added: "If it did, the State could take a DNA sample from every citizen and use it for investigative purposes, an Orwellian prospect."
There is no change in the judgment.
