IT IS ORDERED that the published opinion filed herein on August 4, 2011 (197 Cal.App.4th 1424;___Cal.Rptr.3d___), be modified as follows:

1. At the end of the paragraph beginning near the middle of page 43 [197 Cal.App.4th 1460, advance report, 1st full par.] and ending near the middle of page 44 [197 Cal.App.4th 1461, advance report, 1st par., line 7], the following sentence should be added: “If it did, the State could take a DNA sample from every citizen and use it for investigative purposes, an Orwellian prospect.”

There is no change in the judgment.
