DECISION AND ORDER ON MOTION

Motion to expand record, for copy of transcripts, motions and decisions submitted in County Court and for extension of time to file and serve supplemental pro se brief.

Upon the papers filed in support of the motion, and no papers having been filed in opposition thereto, it is

ORDERED that the motion to expand the record is granted only to the extent that, on or before November 7, 2018, counsel for appellant shall file and serve a supplemental record on appeal to include the following: the notice pursuant to CPL 190.50 dated July 3, 2014 and the certification pursuant to CPL 180.80 (2) (b) dated July 7, 2014, and the Schenectady County Clerk is directed to release to the office of the Schenectady County District Attorney a copy of the grand jury minutes in this matter, and such minutes shall be filed by that office with the Clerk of the Court under separate cover, and it is further

ORDERED that the motion for a copy of the transcripts, motions and decisions submitted in County Court and for an extension of time to file and serve the supplemental pro se brief is denied as unnecessary.
