DECISION & ORDER ON MOTION

Motion by Eric W. Zitofsky, counsel assigned to represent the respondent in the County Court, Rockland County, in effect, to be relieved of the assignment to respond to an appeal by the People from an order of the County Court, Rockland County, dated March 30, 2012, and to enlarge the respondent's time to serve and file a brief.

Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the motion is granted, and Eric W. Zitofsky, Esq., Samsondale Prof. Bldg., Suite 206, P.O. Box 617, West Haverstraw, N.Y. 10993, is directed to turn over all papers in the action to new counsel herein assigned; and it is further,

ORDERED that pursuant to County Law § 722 the following named attorney is assigned as counsel to defend the appeal:

Salvatore Adamo, Esq.
and it is further,

ORDERED that the respondent's time to serve and file a brief is enlarged until October 9, 2012, and the respondent shall serve one copy of his brief and to file nine copies thereof on or before that date.
