ORDER MODIFYING OPINION [NO CHANGE IN JUDGMENT]

THE COURT:

It is ordered that the opinion filed herein on January 12, 2007, be modified as follows:

On page 5, the third full paragraph, line 7, the word “appellant’s” is changed to the word “defendant’s” so that the sentence reads:

Were we to agree with the defendant’s argument on this point we would be substituting the uncertain prospect of a civil recovery for the victim’s constitutional “right to restitution.” We decline to do so.

There is no change in the judgment.
