Oct 5, 2010
77 A.D.3d 672 (N.Y. App. Div. 2010)

Opinion

No. 2009-03626.

October 5, 2010.

Appeal by the defendant from a judgment of the County Court, Westchester County (Zambelli, J.), rendered February 3, 2009, convicting him of predatory sexual assault (two counts), upon his plea guilty, and imposing sentence.

Mark J. Fitzmaurice, White Plains, N.Y., for appellant.

Janet DiFiore, District Attorney, White Plains, N.Y. (Hae Jin Liu, Richard Longworth Hecht, and Anthony J. Servino of counsel), for respondent.

Before: Mastro, J.P., Florio, Dickerson, Belen and Lott, JJ.

Ordered that the judgment is affirmed.

We have reviewed the record and agree with the defendant's assigned counsel that there are no nonfrivolous issues which could be raised on appeal. Counsel's application for leave to withdraw as counsel is granted ( see Anders v California, 386 US 738; People v Paige, 54 AD2d 631; cf. People v Gonzalez, 47 NY2d 606).
