PRESENT:

Defendant having moved pursuant to CPL 460.30 to extend the time to take an appeal from the judgments of Supreme Court, Erie County, rendered September 30, 2016,

Now, upon reading and filing the affidavit of Stanley Brown sworn to September 27, 2017, the notice of motion with proof of service thereof, the statement of Donna A. Milling, Esq. dated November 15, 2017 and the statement of Angelo A. Buffomante, Esq. dated November 15, 2017, and due deliberation having been had thereon,

It is hereby ORDERED that the motion insofar as it seeks CPL 460.30 relief relating to Indictment 2015-0087 (KA 17-01936) is dismissed as unnecessary, and

It is further ORDERED that the motion insofar as it seeks CPL 460.30 relief relating to Indictment 2016-00097/SCI 40749 (KA 17-01937) is granted and Angelo A. Buffomante, Esq. is hereby directed to file and serve the notice of appeal in accordance with CPL 460.10 on or before January 4, 2018.
