People v. Brown

Appellate Division of the Supreme Court of New York, Second Department
Feb 5, 2001
280 A.D.2d 485 (N.Y. App. Div. 2001)

Opinion

Submitted January 3, 2001.

February 5, 2001.

Appeal by the defendant from a judgment of the Supreme Court, Westchester County (Perone, J.), rendered July 8, 1999, convicting him of robbery in the first degree, upon his plea of guilty, and imposing sentence.

Richard S. Birnbaum, White Plains, N.Y., for appellant.

Jeanine Pirro, District Attorney, White Plains, N.Y. (Dean B. Cameron and Richard Longworth Hecht of counsel), for respondent.

Before: FRED T. SANTUCCI, J.P., MYRIAM J. ALTMAN, DANIEL F. LUCIANO, HOWARD MILLER, JJ.

DECISION ORDER

ORDERED that the judgment is affirmed.

The defendant contends that the sentence imposed was not the sentence originally promised, and that the court should have afforded him an opportunity to withdraw his guilty plea. However, since the defendant did not seek to withdraw his plea or move to vacate the judgment, the issue is unpreserved for appellate review (see, People v. Lopez, 71 N.Y.2d 662; People v. Churby, ___ A.D.2d ___ [2d Dept., Nov. 20, 2000]; People v. Pike, ___ A.D.2d ___ [2d Dept., Oct. 16, 2000]; People v. Walters, 273 A.D.2d 418; People v. Gayle, 224 A.D.2d 710). In any event, contrary to the defendant's contention, the record demonstrates that the sentence imposed was the one promised to the defendant.
