On order of the Court, the delayed application for leave to appeal from the March 19, 2002, decision of the Court of Appeals is considered, and it is DENIED, because we are not persuaded that the questions presented should be reviewed by this Court.

Kelly, J., would remand this case to the Wayne Circuit Court for a hearing to determine whether the defendant was denied effective assistance of counsel. People v Ginther, 390 Mich. 436 (1973).
