THE PEOPLE OF THE STATE OF NEW YORK, RESPONDENT, v. ASHLIE BRITTON, DEFENDANT-APPELLANT.


PRESENT:

Counsel for appellant having moved for permission to withdraw as assigned counsel on an appeal taken from a judgment of Onondaga County Court, rendered September 26, 2017, on the ground that the appellant has abandoned the appeal, and respondent having cross-moved to dismiss the appeal,

Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon,

It is hereby ORDERED that the motion of counsel for appellant is granted and Philip Rothschild, Esq. is relieved of his assignment, and

It is further ORDERED that the cross-motion of the respondent is granted and the appeal is dismissed.
