People v. Brito

Appellate Division of the Supreme Court of New York, First Department
Sep 30, 2003
308 A.D.2d 420 (N.Y. App. Div. 2003)

Opinion

1685

September 30, 2003.

Judgment, Supreme Court, New York County (Charles Solomon, J.), rendered January 9, 2001, convicting defendant, upon his plea of guilty, of robbery in the second degree, and sentencing him to a term of 6 years, unanimously affirmed.

Madeleine Guilmain, for respondent.

Adrienne M. Gantt, for defendant-appellant.

Before: Tom, J.P., Sullivan, Rosenberger, Lerner, Friedman, JJ.

The record clearly shows that defendant was sentenced as a first felony offender despite the filing of a predicate felony statement, which was never acted upon. Furthermore, we note that the sentence imposed was in accord with the plea agreement. Defendant is therefore not harmed by the challenged action.

THIS CONSTITUTES THE DECISION AND ORDER OF THE SUPREME COURT, APPELLATE DIVISION, FIRST DEPARTMENT.
