PEOPLE v. BRIM (RONALD EARL)


Record correction granted

Respondent's “Motion to Correct Record on Appeal,” filed on May 22, 2018, is granted. (Cal. Rules of Court, rules 8.634(c); 8.155(c)(2).) The Superior Court is directed to settle a dispute about whether Juror No. 1 said “I can continue” as reported in Volume 13 of the Reporter's Transcript on page 2929, line 13, or if she said “I can't continue,” as asserted in respondent's motion. The trial court should conduct whatever proceedings are necessary, including, as appropriate, hearing testimony by the percipient witnesses.

The previously ordered briefing schedule is vacated, pending further order of this court following the trial court's resolution of the dispute.

Corrigan, J., was absent and did not participate.
