Opinion
B164304.
7-22-2003
Ronnie Duberstein, under appointment by the Court of Appeal, for Defendant and Appellant. No appearance for Plaintiff and Respondent.
Jayme Brianna Clark appeals the judgment entered after conviction following plea of guilty to robbery in which she personally used a firearm. (Pen. Code, §§ 211, 12022.5, subd. (a).) The trial court sentenced Clark to a term of six years in state prison.
We appointed counsel to represent Clark on this appeal. After examination of the record, counsel filed an opening brief in which no issues were raised and which requested this court to conduct an independent review of the record. By notice filed May 27, 2003, we advised Clark to submit any contention, ground of appeal or argument she wished this court to consider within 30 days. No response has been received to date.
We have examined the entire record and are satisfied Clarks counsel has complied fully with counsels responsibilities. (People v. Wende (1979) 25 Cal.3d 436, 443, 158 Cal. Rptr. 839, 600 P.2d 1071.) Further, because Clark seeks to appeal following a plea of guilty but has not obtained a certificate of probable cause and has not raised any issue that does not require a certificate of probable cause, the appropriate disposition is to dismiss the appeal. (People v. Mendez (1999) 19 Cal.4th 1084, 1098-1099, 969 P.2d 146.)
DISPOSITION
The appeal is dismissed.
