People v. Brathwaite

Appellate Division of the Supreme Court of New York, First Department
Oct 27, 1998
254 A.D.2d 210 (N.Y. App. Div. 1998)

Opinion

October 27, 1998

Appeal from the Supreme Court, Bronx County (Efrain Alvarado, J.).

Defendant's valid waiver of his right to appeal precludes any review of his sentence on the ground of excessiveness ( People v. Vasquez, 251 A.D.2d 61; People v. Graham, 220 A.D.2d 215, lv denied 87 N.Y.2d 1019). Moreover, we perceive no abuse of sentencing discretion.

Concur — Milonas, J. P., Ellerin, Wallach and Tom, JJ.
