People v. Brake

Supreme Court of Michigan
Jan 23, 2002
465 Mich. 950 (Mich. 2002)

Opinion

No. 119828 (18).

January 23, 2002.

COA: 232558, Oakland CC: 91-112333-FH

On order of the Court, the delayed application for leave to appeal from the June 25, 2001 decision of the Court of Appeals is considered, and it is DENIED because the defendant's motion for relief from judgment is prohibited by MCR 6.502(G), and he has failed to demonstrate an exception to that rule. The motion for remand is also considered, and it is DENIED.

Cavanagh and Kelly, JJ., would grant leave to appeal.
