People v. Boyle

Appellate Division of the Supreme Court of New York, Second Department
Nov 6, 1961
14 A.D.2d 879 (N.Y. App. Div. 1961)

Opinion

November 6, 1961

Motion by appellant for leave to appeal as a poor person and for the assignment of counsel denied. On the court's own motion, the order of this court dated June 26, 1961, and the order of this court dated October 6, 1958, dismissing the appeal from the order dated May 24, 1957, are vacated. The appellant may perfect his appeals from the orders dated May 24, 1957 and February 9, 1961 on the original papers and typewritten briefs, which shall include copies of the opinions, if any, of the court below. In each appeal, the appellant is directed to file six copies of his typewritten brief and to serve one copy on the District Attorney. The appellant's time to perfect the appeals is enlarged to the February 1962 Term; the appeals are ordered on the calendar for said term. Motion for assignment of counsel denied. The appeals are from orders denying coram nobis applications without hearings. Appellant therefore has in his possession a copy of the original papers to be used in the consideration of the appeals or has full knowledge of the contents of the papers. Nolan, P.J., Beldock, Christ, Pette and Brennan, JJ., concur.
