PRESENT:

Defendant having moved pursuant to CPL 460.30 to extend the time to take an appeal from an order of Yates County Court, dated May 23, 2016,

Now, upon reading and filing the affidavit of John A. Cirando, Esq. sworn to February 13, 2017, the notice of motion with proof of service thereof, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is granted to the extent that the notice of appeal filed at the Yates County Clerk's Office on November 14, 2016 and served on the Yates County District Attorney on November 11, 2016 is hereby deemed timely filed and served.
