An order of this Court having been entered on November 15, 2022 (M-2022-03671), continuing the poor person relief previously granted defendant to prosecute the appeal taken from a judgment of the Supreme Court, New York County, rendered on or about April 30, 2019, under Indictment No. 2668/17, and substituting Robert S. Dean, Esq., predecessor to Mark Zeno, Esq., Center for Appellate Litigation, as assigned counsel to prosecute said appeal, And defendant-appellant having moved to amend the aforesaid order of assignment to include the appeal taken under Indictment No. 2366/17, to deem the notice of appeal timely filed, and for an extension of time in which to perfect the appeal under both Indictment numbers, Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon,
It is ordered that the motion is granted to the extent of deeming the notice of appeal to include the conviction under Indictment No. 2366/17 and amending the aforesaid order of assignment to include said appeal, and extending the time in which to perfect the appeal until 120 days from the date of this order or the receipt of the complete record, whichever is later.
