Appellant having moved for a writ of error coram nobis vacating the order of this Court entered April 20, 2007 affirming a judgment of Supreme Court, Erie County, rendered August 24, 2005,

Now, upon reading and filing the statements of Tony Borden dated March 24, 2016 and filed on April 21, 2016 and April 30, 2016, the notice of motion with proof of service thereof, the affidavit of Michael J. Hillery, Esq. sworn to April 5, 2016, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is denied.
