By order of March 21, 2001, the delayed application for leave to appeal was considered and the prosecutor was directed to file a response within 28 days and to also address therein the applicability of People vYennior, 399 Mich. 892 (1977). The prosecutor having filed with the clerk of this Court a certified copy of the certificate of the defendant's death, the delayed application is again considered, and it is DISMISSED because of the death of the defendant. See People v Posby, 459 Mich. 21, 22 (1998); People v Peters, 449 Mich. 515, 521-522 (1995); People vLopez, 447 Mich. 427, 428 (1994).
