DECISION & ORDER ON MOTION

Motion by the respondent to dismiss an appeal from a judgment of the Supreme Court, Kings County, rendered May 21, 2010, as amended May 25, 2011, on the ground that the transcript filed with the original papers is incomplete.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the motion is denied on condition that on or before January 17, 2012, the appellant make a motion to be furnished, without charge, with the complete transcript of the proceedings of any pretrial hearings, of the plea of guilty or of the trial, and of the imposition of sentence in this action, or file the complete transcript of those proceedings with this Court.
