Appeal from the Supreme Court, Queens County (O'Brien, J.).


Orders reversed, on the law, motions denied, insofar as they sought dismissal of the indictments, indictments reinstated and matters remitted to the Supreme Court, Queens County, for further proceedings.

Evidence of a prior photographic identification of a defendant is legally sufficient evidence to support an indictment ( People v. Brewster, 63 N.Y.2d 419; CPL 190.65). Gibbons, J.P., Weinstein, Brown and Niehoff, JJ., concur.
