MOTION DECISION

DECISION AND ORDER ON MOTION

Motion for extension of time to perfect appeal.

Cross-motion to dismiss appeal for failure of prosecution or, in the alternative, to relieve Cortland County Public Defender's Office of assignment and assign new counsel for appellant.

Upon the papers filed in support of the motion and the cross-motion and the papers filed in opposition thereto, it is

ORDERED that the cross-motion is denied without prejudice to renewal in the event the appeal is not perfected on or before December 23, 2024, and it is further

ORDERED that the motion is granted and the time to perfect the appeal is extended to December 23, 2024. No further extensions of time to perfect the appeal will be granted. In the event the appeal is not perfected by December 23, 2024, the appeal may be dismissed for failure of timely prosecution upon the Court's own motion.
