Nov 13, 2007
45 A.D.3d 693 (N.Y. App. Div. 2007)

Opinion

No. 2004-08540.

November 13, 2007.

Appeal by the defendant from a judgment of the Supreme Court, Queens County (Rotker, J.), rendered September 15, 2004, convicting him of burglary in the second degree, upon his plea of guilty, and imposing sentence.

Lynn W. L. Fahey, New York, N.Y. (David P. Greenberg of counsel), for appellant.

Richard A. Brown, District Attorney, Kew Gardens, N.Y. (John M. Castellano and Merri Turk Lasky of counsel; Michelle Kaszuba on thebrief), for respondent.

Before: Crane, J.P., Ritter, Fisher, Covello and Dickerson, JJ., concur.

Ordered that the judgment is affirmed.

We have reviewed the record and agree with the defendant's assigned counsel that there are no nonfrivolous issues which could be raised on appeal. Counsel's application for leave to withdraw as counsel is granted ( see Anders v California, 386 US 738; People v Paige, 54 AD2d 631 [1976]; cf. People v Gonzalez, 47 NY2d 606).
