Judgment of the County Court, Kings County, convicting defendant of the crime of robbery in the first degree, reversed on the law and the facts and a new trial ordered. (See People v. Giffone, No. 109 E. [ post, p. 735], decided herewith.) Close, P.J., Hagarty, Carswell and Johnston, JJ., concur; Adel, J., dissents and votes to affirm the judgment for the reasons assigned in his dissent in People v. Giffone ( supra).
