Appeal from Madison County Court.

Present — Foster, P.J., Heffernan, Brewster, Deyo and Bergan, JJ.


Appellant and one Hart were indicted for the crimes of robbery, first degree, grand larceny, first degree, and assault, second degree, committed against one George Gilcher. Hart pleaded guilty, on a separate occasion, to the crimes charged in the indictment. On the trial of appellant he testified for the People. Assuming that he was an accomplice his testimony was corroborated by other evidence which tended to connect appellant with the commission of the crime (Code Crim. Pro., § 399). The evidence was sufficient to warrant the jury in finding the appellant guilty beyond a reasonable doubt. We find no errors so prejudicial as to require the judgment to be set aside. Judgment of conviction unanimously affirmed.
