Petitioner filed an application for leave to appeal in the Michigan Supreme Court, raising the same claims he raised in the Michigan Court of Appeals. The supreme court reversed the decision of the court of appeals and remanded the case to the trial court, with instructions to hold an evidentiary hearing on Petitioner's claim that his trial counsel was ineffective for "failing to argue that the instruction on the lesser offense was barred by People v Cornell, 466 Mich 335; 646 N.W.2d 127 (2002)." People v. Blackshire, 497 Mich. 1033, 1033-34 (2015) (table). As of now, it seems that the evidentiary hearing was held on September 22, 2015, but a decision has yet to be made.
