People v. Blackmore

Appellate Division of the Supreme Court of New York, Second Department
Feb 24, 2000
269 A.D.2d 537 (N.Y. App. Div. 2000)

Opinion

Submitted January 11, 2000

February 24, 2000

Appeal by the defendant from a judgment of the Supreme Court, Kings County (Minardo, J.), rendered June 25, 1996, convicting him of burglary in the second degree, upon a jury verdict, and imposing sentence.

Steven A. Feldman, Roslyn, N.Y., for appellant.

Charles J. Hynes, District Attorney, Brooklyn, N.Y. (Roseann B. MacKechnie, Victor Barall, and Marie-Claude P. Wrenn of counsel), for respondent.

DAVID S. RITTER, J.P., MYRIAM J. ALTMAN, DANIEL F. LUCIANO and SANDRA J. FEUERSTEIN, JJ.

DECISION ORDER

ORDERED that the judgment is affirmed.

Contrary to the defendant's contention on appeal, the Supreme Court did not err in granting the People's reverse-Batson motion (see, People v. Payne, 88 N.Y.2d 172 ; People v. Richie, 217 A.D.2d 84 ).

The defendant's remaining contention lacks merit.
