ORDER DENYING REHEARING & MODIFYING OPINION [NO CHANGE IN JUDGMENT]

It is ordered that the opinion filed herein on August 26, 2011, be modified as follows:

Footnote three on page three is deleted and replaced with the following:

"In the context of a motion Blackmon brought under People v. Marsden (1970) 2 Cal.3d 118, the trial court stated: 'Based on what I've heard, Mr. Blackmon, I am going to deny your request based on today that you're not prepared to proceed with representing yourself. The issues that you have raised indicate to me a desire to prevent the preliminary exam from taking place.' "

There is no change in the judgment.

Appellant's petition for rehearing is denied.
