Respondent having moved to dismiss the appeal taken herein from an order of the Orleans County Court, dated July 3, 2018, on the ground that appellant has failed to perfect timely the appeal,

Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon, and there being no opposition thereto,

It is hereby ORDERED that the motion is dismissed as unnecessary (see 22 NYCRR 1250.10 [a]).
