Appellate Division of the Supreme Court of New York, Second Department
May 9, 2006
29 A.D.3d 706 (N.Y. App. Div. 2006)

Opinion

2004-05169.

May 9, 2006.

Appeal by the defendant from a judgment of the Supreme Court, Kings County (Del Giudice, J.), rendered May 27, 2004, convicting him of criminal possession of a weapon in the third degree, upon his plea of guilty, and imposing sentence.

Lynn W.L. Fahey, New York, N.Y., for appellant.

Charles J. Hynes, District Attorney, Brooklyn, N.Y. (Leonard Joblove and Linda Breen of counsel; Robert Ho on the brief), for respondent.

Before: Florio, J.P., Santucci, Mastro, Rivera and Covello, JJ., concur.

Ordered that the judgment is affirmed.

We have reviewed the record and agree with the defendant's assigned counsel that there are no nonfrivolous issues which could be raised on appeal. Counsel's application for leave to withdraw as counsel is granted ( see Anders v. California, 386 US 738; People v. Paige, 54 AD2d 631; cf. People v. Gonzalez, 47 NY2d 606).
