The decision of the Second District Court of Appeal, Division One, is vacated, and the matter is transferred to that court for reconsideration in light of Luz v. Lopes (1960) 55 Cal.2d 54, 59; Critzer v. Enos (2010) 187 Cal.App.4th 1242, 1248-1249; and D'Avola v. Anderson (1996) 47 Cal.App.4th 358. (Cal. Rules of Court, rule 8.528(d).)
