On order of the Court, the delayed application for leave to appeal from the February 23, 1999, decision of the Court of Appeals and the motion to remand are considered. The application for leave to appeal is DENIED, because the defendant has failed to meet the burden of establishing entitlement to relief under MCR 6.508(D). The motion to remand is DENIED.

Kelly, J., would remand this case to the Court of Appeals for consideration as on leave granted.
