Opinion

2d Crim. No. B168444.

11-24-2003

THE PEOPLE, Plaintiff and Respondent, v. TIMOTHY JOHN BECKER, Defendant and Appellant.

California Appellate Project, Jonathan B. Steiner, Executive Director, and Richard B. Lennon, Staff Attorney, under appointment by the Court of Appeal, for Defendant and Appellant. No appearance for Plaintiff and Respondent.

Timothy John Becker appeals a judgment entered following his guilty plea to second degree murder. (Pen. Code, § 187, subd. (a).) The trial court sentenced Becker to a prison term of 15 years to life.

We appointed counsel to represent Becker in this appeal. After counsels examination of the record, he filed an opening brief raising no issues.

On October 1, 2003, we advised Becker that he had 30 days within which to personally submit any contentions or issues that he wished to raise on appeal. We have received a response from him requesting to withdraw his plea and proceed to trial.

We have reviewed the entire record and are satisfied that Beckers attorney has fully complied with his responsibilities and that no arguable issues exist. (People v. Wende (1979) 25 Cal.3d 436, 441.)

The judgment is affirmed.

We concur: YEGAN, J., PERREN, J.
