ORDER

On order of the Court, the application for leave to appeal the August 6, 2021 order of the Court of Appeals is considered. We DIRECT the Wayne County Prosecuting Attorney to answer the application for leave to appeal within 28 days after the date of this order. In particular, the prosecutor shall address whether the Wayne Circuit Court erred in failing to instruct the jury on involuntary manslaughter in the defendant's trial, and if so, whether the defendant should be allowed to withdraw his plea.

The application for leave to appeal remains pending. 1
