THE COURT:

The opinion filed December 10, 2001, (94 Cal.App.4th 370; 114 Cal.Rptr.2d 285) is modified as follows:

Page 2, end of first paragrah [94 Cal.App.4th 377, line 5], add the following sentence: "We reverse, finding prejudicial error in the exclusion of defense evidence and in the unlawful mention that a key prosecution witness underwent a polygraph examination."

The petition for rehearing is denied.

There is no change in the judgment.
